Terms Of Service
- The Widget Ad Generator account owner, (herein
referred to as 'Owner') agrees to waive liabilty of
Royal Responder, Inc. (the parent company) (herein
referred to as 'Widget Ad Generator ') from any claims
resulting from misuse of the software. Owner agrees to
defend, indemnify and hold harmless Widget Ad Generator
and its affiliated companies, from all liabilities,
claims and expenses, including attorneys' fees, arising
from breach of this Agreement. Widget Ad Generator
software may only be used for lawful purposes.
- By purchasing this product or any other
products available on this site, you, the
Owner, and any and all third-parties or assignees of
said Owner, agree to use Widget Ad Generator
software, or other products, in accordance with the
policies required by eBay,
ClickBank or any other affiliate Network,
and in compliance with any and all applicable
local, state, and federal laws of the United States of America.
- Widget Ad Generator completely disclaims any and all
responsibility for any Owner found
to be using Widget Ad Generator's software for unlawful
purposes whether in violation of local, state and
federal laws of the United States of America.
- Owner understands that use of the Widget Ad Generator
software is only granted to those individuals, companies
and organizations that make appropriate payment to
Widget Ad Generator. Owner further agrees that Widget Ad Generator
has the right to deactivate the software if payment
later fails, if Owner requests a refund or chargeback,
or if Owner engages in unlawful activity with the Widget Ad Generator
software.
- Owner agrees that the Widget Ad Generator software can only be
installed on one domain and that attempts to install on
additional sites will be blocked. Owner understands that the Widget Ad Generator
ad blocks can be displayed on an unlimited number of sites using the
provided javascript code and PHP code. While the Widget Ad Generator
can be displayed on as many sites as you wish, the Widget Ad Generator software
can only be installed on (1) one domain.
- Owner understands that use of the Widget Ad Generator
software may result in commissions earned and paid by Clickbank, eBay or
other affiliate networks for which you belong. Owner further acknowledges
that commissions earned, and paid, by Clickbank, eBay, or other affiliate networks, are a direct result of
the traffic owner sends via the Widget Ad Generator ad block displays
on their website, and that Widget Ad Generator is not responsible,
liable, or at fault in any way, for Owners failure to earn commissions.
Futhermore, Owner agrees that Widget Ad Generator
has made no guarantees regarding the earning potential
of any Affiliate program for which you belong.
- Owner understands that a valid email address
is required by Widget Ad Generator for use of this
software. Widget Ad Generator will NOT give your email
address to any 3rd party. Any correspondence sent to
you will come directly from Widget Ad Generator or Royal
Responder, Inc. the parent company.
- Widget Ad Generator makes no warranties of any
kind for the software it provides, whether expressed or
implied. Widget Ad Generator will not be held liable for
any damages suffered to owner.
- Owner agrees to receive periodic software
updates and new software releases (via email) from
Widget Ad Generator or Royal Responder, Inc. the parent
company.
- Widget Ad Generator DOES NOT WARRANT THAT THE
SOFTWARE WILL BE ERROR FREE OR UNINTERRUPTED. THE
SOFTWARE IS DISTRIBUTED ON AN "AS IS" BASIS WITHOUT
WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED,
INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR
PURPOSE. Widget Ad Generator WILL NOT BE RESPONSIBLE FOR
ANY LOSSES, DAMAGES OR COSTS THAT YOU AND/OR YOUR
BUSINESS MAY SUFFER WHEN USING THE SOFTWARE. YOU AGREE
TO INDEMNIFY AND HOLD HARMLESS Widget Ad Generator FROM
ANY CLAIMS RESULTING FROM YOUR USE OF Widget Ad Generator
SOFTWARE. YOU EXPRESSLY AGREE THAT USE OF
Widget Ad Generator SOFTWARE IS AT YOUR SOLE RISK.
NEITHER Widget Ad Generator NOR ITS SERVICE PROVIDERS,
AGENTS, LICENSORS, EMPLOYEES SHALL HAVE ANY LIABILITY
FOR ANY DAMAGES SUFFERED BY YOU OR ANY OTHER PARTY AS A
RESULT OF THE USE OR MISUSE OF THE Widget Ad Generator
SOFTWARE.
- Should any paragraph of this agreement be
considered illegal, invalid, or unenforceable by a
court of law, the legality, validity and enforceability
of the remaining paragraphs of this agreement shall
remain unaffected thereby unless otherwise stated.
- This service agreement is governed by the laws
of the state of Colorado and of the United States of
America.
- These Terms and Conditions supersede all
previous written, verbal or implied provisions. Use of
Widget Ad Generator software constitutes acceptance of
these Terms and Conditions. Widget Ad Generator reserves
the right to make changes and ammendments to these
terms and conditions at any time. Widget Ad Generator
agrees to notify account owners of any changes or
ammendments by email OR by posting changes on this
page.
